Proving a Surgical Error Case in Miami-Dade County
Establishing that a surgical outcome constitutes malpractice rather than an inherent risk of the procedure requires satisfying four elements under Florida law: a duty of care arising from the provider-patient relationship, a breach of the prevailing professional standard of care, a direct causal link between that breach and the injury, and compensable damages. A signed consent form doesn’t automatically defeat a claim. The provider may still have failed to meet the standard of care regardless of risks the patient acknowledged before surgery.
Florida’s Pre-Suit Requirements
Florida law imposes mandatory pre-suit requirements before litigation can begin. We must conduct a pre-suit investigation, obtain a sworn affidavit from a qualified medical expert confirming the standard of care was breached, and serve written notice of intent to sue on the healthcare provider. That notice triggers a 90-day period during which the provider may investigate and offer settlement before the case proceeds to the Eleventh Judicial Circuit Court.
Florida’s Statute of Limitations for Surgical Malpractice
Timing matters. Florida law requires medical malpractice claims to be filed within two years from discovery of the injury, with a four-year outer limit from the date of the incident. If the provider concealed the error or engaged in fraud, that deadline may extend to seven years. The sooner we can review the facts, the more completely we can protect your claim.
