The Presuit Notice Requirement
Under Florida Stat. § 766.106, you can’t file a lawsuit directly. First, you must serve a written notice of intent to initiate litigation on each prospective defendant, supported by a verified medical expert opinion confirming grounds for the claim. After notice is delivered, a 90-day period begins during which the defendant’s insurer investigates and the parties may attempt pre-litigation resolution. The statute of limitations is tolled during this window.
Statutes of Limitations & Deadlines for Minors
The standard statute of limitations for Florida medical malpractice claims is two years from the date the injury was discovered or reasonably should have been discovered. Florida also imposes a four-year statute of repose: no claim may be filed more than four years after the negligent act, regardless of discovery. Florida’s Tony’s Law creates an important exception for birth injuries. In most cases, parents have until the child’s eighth birthday to file a claim on the minor’s behalf, provided the injury was not and could not reasonably have been discovered sooner.
