  • Two-year discovery rule: Florida generally requires a malpractice lawsuit to be filed within two years from the date the patient discovered, or reasonably should have discovered, the injury caused by the misdiagnosis.
  • Four-year statute of repose: In most cases, a hard four-year deadline applies from the date the malpractice occurred, regardless of when it was discovered, with limited exceptions.
  • Fraud or concealment exception: When a medical provider used fraud or concealment to hide the misdiagnosis, the deadline may be extended to seven years from the date of the act.
  • 90-day presuit investigation period: Before any lawsuit can be filed, Florida law requires the claimant to serve a formal notice of intent to initiate litigation, triggering a mandatory 90-day presuit investigation period during which the defendant may investigate the claim.
