What is a Never Event in Medical Malpractice?

Doctors and other medical professionals are entrusted with the health and well-being of their patients. What is Considered a Never Event?

A never event is a mistake that is so outrageous that, regardless of the circumstances, there is no excuse for it.

These are some examples of mistakes that are typically referred to as never events:

  • Surgical errors: Mistakes, such as operating on the wrong body part, operating on the wrong patient, or accidentally leaving a medical instrument or device in a patient’s body, are all examples of never events that occur during surgery.
  • Errors involving medical devices: When a doctor misuses a device or a product, or uses a device that is contaminated, it can result in serious injuries to a patient, some of which might even be fatal.
  • Environmental accidents: An example of an environmental accident that could result in a never event can occur if a patient’s oxygen lines contain the wrong gas. Electrical shocks and burn injuries are other environmental accidents that should never occur while a patient is in the care of a doctor, medical facility or hospital.
