On December 8, 2014, the United States Supreme Court denied BP's appeal to undo the landmark Settlement for the people and businesses of the Gulf Coast after causing the world's greatest environmental disaster in April 2010 when its oil well blew up, sinking the Deepwater Horizon rig, killing 11 men, and spilling millions of gallons of crude oil into the Gulf of Mexico.
Since BP entered into, publicly supported, and encouraged people and businesses to participate in the Settlement, the foreign company has had buyer's remorse and been fighting the deal it made in an attempt to get out of paying the claims. Rather, BP has paid hundreds of millions to its lawyers, in pro-BP advertisement campaigns, and in anti-claimant advertisement campaigns to try and sway public opinion, including the courts that hear their frivolous appeals.
The Supreme Court has now put an end to BP's scorched earth tactics, and BP must now pay the claims, although it will certainly attempt, by spending millions more, to employ further delay tactics.
A VERY IMPORTANT ramification of the Supreme Court's denial is that the deadline for filing individual, business, and property claims is now just six (6) months from December 8, 2014, or by June 8, 2015. If you do not file your claims by June 8, 2015, your claim will be barred forever. This deadline does not apply to vessel owner, captain, and crew claims related to commercial fishing that were subject to the Seafood Compensation Program deadline of January 22, 2013.
